Good to know
The money owed when employment ends: gratuity (fixed-term contracts) or severance pay (redundancy, death in service, medical discharge), pay for leave days not taken, and pay instead of notice if notice was not given.
At least two months' basic pay for every year served, paid by the last day of work (Employment Code sections 54 and 55). If it isn't paid by then, the employer keeps paying full wages until it is.
There is no severance pay on resignation or dismissal, but leave days not taken must still be paid. On a fixed-term contract, check your contract for gratuity.
Unless the contract says otherwise: 24 hours for contracts up to a month, 14 days up to three months, and 30 days for longer contracts (section 53). Without notice, the employer pays the wages for that period.
Leave pay and notice pay are taxed through PAYE. Gratuity up to 25% of basic pay is treated as gratuity under the Income Tax Act. Ask your employer or ZRA how your payout is taxed; this calculator shows it before tax.
